Special Needs Education
The Individuals with Disabilities Act (IDEA) guarantees each child with a disability, a Free Appropriate Public Education. Our attorney works with clients to ensure that they, or their loved ones, obtain an Individual Education Plan (IEP). An IEP describes an individual’s present levels of performance, identifies the accommodations and modifications necessary to provide them with a Free Appropriate Public Education, then ensures that the IEP is followed with fidelity. Where an IEP is not done, the Firm stands ready to defend the rights of it’s clients.

Financial Planning
Durojaiye Law assists its clients in planning for the financial provision of their disabled loved ones. This planning may include the creation of a Special Needs Trust and counsel in funding and managing the Trust.

Planning for Adulthood
Durojaiye Law also works ardently to assist our clients in preparing for the adulthood of their loved ones. The law grants everyone the right to self-determination (the right to make his or her own decisions) upon reaching the age of majority at eighteen (18) years of age.

Individuals with disabilities may not have the skills, knowledge and discernment to make decisions in their own interest and safety. Therefore, Florida Law allows parents, siblings, or friends with sufficient interest in the well-being of the disabled individual, to be appointed a guardian or guardian advocate.

Durojaiye Law will guide the proposed guardian or guardian advocate through the process, ensuring that the Court is able to appoint a guardian or guardian advocate who will act in the best interest of the disabled adult, while protecting the individual with disability from abuse and from being taken advantage of.

Guardian Advocacy
Individuals with developmental disabilities, a Guardian Advocate is appointed without the determination of incapacity. This significantly alleviates the burden on families already dealing with the challenges of bringing up a child with special needs or a developmental disability. Durojaiye Law will provide legal representation, assist with creation of the necessary legal documents and filing for guardianship.
